6. Payment
6.1. We are committed to providing secure online payment facilities. All transactions are encrypted using appropriate encryption technology.
6.2. Debit card; payment made by debit card may require additional information to authorise and verify the validity of payment. We will withhold delivery until the additional information is received and authorisation is obtained for the due amounts. You warrant that you are fully authorised to use the debit card supplied to pay for the products. You also warrant that your debit card has sufficient available funds to cover all the costs incurred as a result of the services used on the Website;
6.3. Credit card: payment made by credit card may require additional information to authorise and verify the validity of payment. We will withhold delivery until the additional information is received and authorisation is obtained for the due amounts. You warrant that you are fully authorised to use the credit card supplied to pay for the products. You also warrant that your credit card has sufficient available funds to cover all the costs incurred as a result of the services used on the Website;
6.4. Direct bank deposit or electronic funds transfer: payments via direct bank deposit or electronic funds transfer must be made within 5 (five) days of placing your order. Love 2 Sew will not accept your order if payment has not been received;
6.5. Instant EFT; payments made by instant EFT must first reflect in our bank accounts, upon which we will recognise your payment for your order.
6.6. We will send you email communications about your order and payment.
6.7. Once you have selected your payment method, you will be redirected to a link to a secure site for payment.

7. Delivery of products
7.1. We offer delivery via courier in South Africa.
7.2. Orders paid for in full, exceeding R1,500.00, will be free of charge.
7.3. Our delivery charges are subject to change without prior notice.
7.4. Applicable delivery charges will be listed in your cart before you check out.
7.5. When you accept your order, Love 2 Sew will deliver your purchased products to you as soon as reasonably possible, but no later than 30 (thirty) days of receipt of your payment.
7.6. We will notify you if we cannot deliver the Goods during the Delivery Period. You may then, within 7 (seven) days of receiving such notification, elect whether or not to cancel such order in writing to orders@https://love2sew.co.za/, If you elect to cancel your order, we will reimburse you for the purchase price.
7.7. Love 2 Sew’s obligation to deliver any purchased product from us is fulfilled when we deliver your order.
7.8. Love 2 Sew is not responsible for any loss or unauthorised use of a purchased product after it has been delivered to the physical address nominated by you.

8. Errors
8.1. We shall take utmost care and reasonable efforts to ensure accuracy to reflect in our product description and pricing. Should there be any errors of whatsoever nature on the Website, we shall not be liable for any loss, claim or expense other than the purchase price of the product concerned.
8.2. Love 2 Sew shall not be bound by any incorrect information regarding our products displayed on any third-party websites.
8.3. Any claims as per 8.1 must comply with the requirements stipulated in our Returns Policy.

9.1. Love 2 Sew is not currently VAT registered, but it will be in future.

11. Governing law and jurisdiction
11.1. These Terms and Conditions and our relationship and any dispute arising from or in connection with these Terms and Conditions shall be governed and interpreted by the laws of the Republic of South Africa. Your continued use of the Website will constitute your consent and submission to the jurisdiction of the South African courts regarding all proceedings, transactions, applications or the like instituted by either party against the other arising from any of these Terms and Conditions.
11.2. In the event of any dispute arising between you and Love 2 Sew, you hereby consent to the non-exclusive jurisdiction of the High Court of the Republic of South Africa (Gauteng Division, Pretoria), notwithstanding that the quantum in action or proceedings may otherwise fall below the monetary jurisdiction of that court.
11.3. Nothing in this clause ten or the Terms and Conditions limits your right to approach any court, tribunal or forum of competent jurisdiction in terms of the Consumer Protection Act “CPA”.

12. Notices
12.1. Love 2 Sew selects Your Address as its address for service of all formal notices and legal processes in connection with these Terms and Conditions. Love 2 Sew may change this address from time to time by updating these Terms and Conditions.
12.2. You hereby select the delivery address specified with your order as your legal address, but you may change it to any other physical address by giving Love 2 Sew notice in writing, not less than seven days.
12.3. Notices must be sent in English by hand, prepaid registered post, or email. All notices sent –
12.4. by hand will be deemed to have been received on the date of delivery;
12.5. by prepaid registered post will be deemed to have been received ten days after the date of posting;
12.6. by email will be deemed to have been on the date indicated in the “Read Receipt” notification. ALL EMAIL COMMUNICATIONS BETWEEN YOU AND US MUST MAKE USE OF THE “READ RECEIPT” FUNCTION to prove that an email has been received.

14.1.2. Any failure on your or Love 2 Sew’s part to enforce any right in terms hereof shall not constitute a waiver of that right.
14.1.3. If any term or condition is declared invalid, the remaining terms and conditions will remain in full force and effect.
14.1.4. These Terms and Conditions contain the whole agreement between you and Love 2 Sew.
14.1.5. No other warranty or undertaking is valid unless contained in this document between the parties.
